• Obiettivi formativi

  1. The course aims to provide the students the core concepts of Fuller’s book "The Morality of Law".
  2. Particular attention will be paid to the reading and to the discussion of some passages of MoL, in order to stimulate students to develop their ability in pursuing subjects through increasing their linguistic skills.

• Programma del corso

  1. What does the “morality of duty” and “morality of aspiration” mean in Fuller’s conceptual framework;
  2. The “morality of duty” as a system of basic rules for an ordered society;
  3. The “grudge informer” as an introduction to Fuller’s eight requirements of the rule of law;
  4. The eight requirements in the case of the “rex” lawmaker: about generality, publicity, non-retroactivity, clarity, non-contradiction, reasonableness, constancy and congruity as necessary criteria;
  5. The “internal morality” and his relation to “morality of duty” and “of intention”;
  6. Fuller’s critic to the legal positivism’s distinction between law and morals;
  7. A procedural natural law theory: Fuller’s law as a dynamic process of creation-discovery and the model of the law merchant.
